New Act a boon to buyers

OWNERS of new high-rise units can expect to receive their strata titles upon moving into their property once the new Strata Management Act 2013 (Act 757) is implemented early next year.

Penang Municipal Council (MPPP) president Datuk Patahiyah Ismail said that under the new Act, the developers had to submit the schedule of parcel to the Land and Mines Office when the architect-in-charge issued the Certificate of Completion and Compliance.

“With the submission of the schedule, the Land and Mines Office will then issue the strata titles for the units.

“Previously, developers had to wait for six months before they can apply for the strata titles upon submitting the schedule of parcel,” she said at the Strata Management Act 2013 Seminar at Rainbow Paradise Beach Resort on Saturday.

Patahiyah said: “Under the new Act, developers were required to submit the schedule of parcel with the issuance of CCC and vacant possession.

“The new Act will replace the Building and Joint Property (Ma-nagement and Maintenance) 2007 (Act 663).”

She said: “The improvements in the new Act include the marking of a shared common area of the property in the strata plan, submission of schedule of parcel to Commissioner of Building (CoB) and the setting up of a strata management tribunal.”

Meanwhile, state Housing, Town and Country Planning Committee chairman Jagdeep Singh Deo, who opened the seminar, called upon the council to increase its manpower for the CoB to better handle the high demand of work from the 1,179 high-rise housing schemes on Penang island.

He added that from the schemes, there was a total of 173,906 parcels (units) while there are only 10 CoB in the council.

“One of the main complaints I received is that action is not taken quickly by the CoB but I can’t blame them as there is lack of manpower.”

Patahiyah said she will look into this and improve the situation soon.

    Dear sir or madam, good morning!

    For your information that my company have 25 units in a medium-cost flat which have the total units of 50.

    But why when in AGM, we have one vote only?
    How to calculate the percentage of the attendance and votes?

      Hi Niki,
      Noe that when you own 25 units out of 50 you can request to vote by shares, you will have 50% of the votes.

  2. i am house owner, please let me know if the JMB management violate the Rules since they allowed the JMB Secretary to open his private companly and lobbying to control House for Rent / Sale inside the premises. We really puzzle by the illegal application which can be against the legal nature of complex of interest. By the way what actually be the meaning of complex of interest ? thanks

      Hi Norhayati, I suggest you write to the COB (Commissioner Of Building) in your area they will advise you accordingly. You need to show proof though, is the person really the owner of the company?

    My maintenance provider SP services recently cut off my electricity supply. They not only pull the fuse and also cut the.wires. my children are using candles.
    Are their action legal. What can I do.

      Hi Yessaya,
      1, Whatever the reason they cannt do such thing especially if i is under TNB.
      2. You should launch a police report.
      3. Inform TNB about this incident
      4. Kids should not play with fire.
      5. Make sure you are paying for the maintenance fees.
      6. Inform COB in written

    How to treat an agent.
    1) New tenant moving, passes the ‘moving in/out’ form to the agent to fill in; and yet didnt.
    2) New tenant move in the furniture, without informing the management but that agent inform the security..

    What should I do..

      In my knowledge, it is good practice for the management company to keep record of people moving in and out.
      There should be a standard Operation Procedure made in place for the owners-Management-Security. If there is no letter from the management, the security should be firm and do not let pass the movers.
      Owners have to cooperate as well.
